Man Found Guilty for B&B Murder

Louis Joseph DiBernardo, 60, was found guilty today on second-degree murder.

UPDATE: This story was updated with reaction from the defendant's daughter at 7:04 p.m.

The owner of a Wine Country B&B was found guilty today of second-degree murder for gunning down a former business associate he believed was cheating him.

He fatally shot his former business associate, Victor Borcherds, also 60, at The Castle Bed and Breakfast during a dispute over the property.

Sherry DiBernardo, the defendants wife, buried her face in her hands and quietly wept as the jury filed out of the courtroom.

Family members left the courtroom quickly, walking closely together, some holding each other.

"I love my dad, I believe him, and I believe he was failed by the system," said DiBernardo's daughter, Leana Derouin.

This was the second time the defendant stood trial for these charges.

The first trial ended in December, and a jury convicted him on charges of kidnapping and making threats, though they could not come to a consensus on a murder charge.

The shooting was the climax of a disagreement between DiBernardo and Borcherds over the rent the victim was supposed to pay the defendent, who owned The Castle.

Borcherds was living in the B&B with his wife, Suzanne. She and DiBernardo are the only living witnesses to what happened leading up to the victim's death.

DiBernardo was trying to evict the Borcherdses, who agreed to pay $12,000 per month in rent, though never made a full payment.

The court system failed to help DiBernardo get his unwanted tenants out of his home, and it failed him by returning a guilty verdict, his daughter said today.

"I'm disappointed, and I feel like this is the same system that failed him before when he was going through all this mess," she said. "It failed him again."
