Prosecutor: Defendant Lived 'High Life' by Stealing Tribal Funds

A former accountant for the Pechanga Band of Luiseno Indians and an ex-insurance broker stole about $4 million from the tribe by diverting funds reserved for insurance coverage, a prosecutor alleged today.

But the defendants' attorneys said the case stems from a business dispute and nothing more.

James William Riley, 48, of Corona and Ryan Jay Robinson, 41, of Temecula were indicted in February 2010 on multiple felony charges stemming from a scam that the pair allegedly perpetrated between 2005 and 2007.

Riley -- a former insurance broker and partner at Riley, Garrison & Associates -- could face 15 years in prison and six-figure fines if convicted of three counts each of grand theft, commercial burglary and money laundering.

Robinson, the Pechanga tribe's former chief financial officer, is facing up to 10 years behind bars if convicted of grand theft and three counts of burglary.

As the men's trial got under way Wednesday, the prosecution called witnesses who explained the process of setting up property and liability insurance policies and deciphering cost breakdowns.

Riverside County Deputy District Attorney Jeanne Roy displayed copies of documents drawn up by Riley that revealed how, in a one-month span in 2006, premiums on an insurance policy for the Pechanga Development Corp. went from $555,000 to $1.32 million.

Roy alleged the sum was artificially inflated by the defendant, who pocketed $410,000 in “fees” from the transaction. The prosecutor told City News Service that Riley and Robinson allegedly began scamming the tribe shortly after Hurricane Katrina in September 2005.

Commercial insurance rates went through the roof following the disaster, enabling the defendants to justify exorbitant insurance costs from which they were profiting, Roy said.

 “Mr. Riley was living the high life,'” she said, adding that Robinson used the $190,000 he allegedly received in kickbacks to “pay off his gambling debts.

“The bottom line is, when the interim CEO for Pechanga asked these two defendants in 2006 why the tribe's insurance costs were so high, they never answered the question,” Roy told CNS.

According to Riley's attorney, Souley Diallo, his client never committed a crime, and the prosecution's case boils down to a misunderstanding of complex financial arrangements.

“This is a dispute between sophisticated business people over commercial transactions,” Diallo said.

“It should never have ended up in a criminal court.”

Chris Jensen, Robinson's legal counsel, acknowledged that his client received $190,000 in cashier's checks from Riley, but said there's no evidence that the funds were part of a bribe or arose from a conspiracy to rip off the tribe. The trial is expected to last about two weeks. Riley is free on $1 million bail, and Robinson is free on a $120,000 bond.

It wasn't the interim CEO, but CFO. Maybe you should share a little more of what Souley Diallo shared. Like the fact that James Riley had been writing the insurance for Pechanga since the late 90's not needing to bribe Robinson, who WAS NOT the only decision maker in the process. He first had to present all the information to the Board. Also, Diallo shared that in commercial insurance, BY LAW, you can charge ANY amount you want and not have to disclose ANY fee's whatsoever(Although Riley did disclose the amounts). James Riley has given to people his whole life, and he had no knowledge of Robinson having a gambling issue. Robinson truly went through a divorce and also needed money to buy a business(both documented). But I guess you guys didn't want to share any of that because you just like watching train wrecks.

"Factofthematter" probably is Anthony Miranda, another thief who stole from Pechanga for years. He belongs in a cell with the rest of the crooks.

This is not Anthony Miranda. These men are not crooks. These men will be exonerated, you just watch!! The justice system is flawed, which is why these guys even got indicted in the first place. Maybe if you actually sat in the courtroom listening to the D.A.'s nonsense you would understand how ridiculous this whole case is. Other things going on at Pechanga I could care less about.

All comes down to getting the "GOLD" Balanced right in the big City Hall right? We areRead More broke we are broke! We have how many more million dollar residents, ranches, farms who pay taxes, how many more business's, triple, quadruple, on and on that pay taxes, and some very large business's at that for YEARS. Yet Murietta and Menifee with just the few they have can manage to not only put in side walks, AND ALSO ACTULLY Listen their residents, instead of call them names like Paul has been, concerns and respond to them. Hell we are just now getting some attention to our driving issues with running red lights, speeding, not stopping at stop signs, driving drunk, high, or wreeklessly causing deaths and serious injuries to walkers, bike riders, skate board, scooter riders, wheelchairs, motor bike riders, and other cars. But how many lives were lost or severly disabled until we just now the last 2 weeks have been giving traffic details for different areas, cell phone details, etc. Lucky to get some sidewalks finished in 10 years if someone doesnt figure out where our "Gold" is we all pay in. And stop calling names people at the City meetings to Paul or anyone else trying to get our City to do what its there for. By the time someone in your own family is killed they will be laughing at you for standing up asking for sidewalks right? Just like on the "Patch" comment areas, always calling names instead of sticking with your fellow Temeculites and getting us something DONE! Before we loose more lives
