Suit Against Pot Co-op Shelved

The City of Temecula's lawsuit against a medical marijuana group is stayed, allowing the shop to distribute the drug for the foreseeable future.

A lawsuit aiming to stop a shop from selling medical marijuana was shelved with no end in sight.

Judge Craig Riemer ordered on Monday the suit to be stayed until a case was resolved that will decide whether a city can bar a medical marijuana group from dispensing, according to court records.

"All proceedings in this case are stayed at least until such time as the Court of Appeal, Fourth Appellate District, Division Two decides whether municipalities may prohibit medical marijuana dispensaries," reads the judges order.

"We're thrilled with the judge's ruling," said Robin Sax, a spokesperson for the co-op. "We know this is going to the supreme court and we're confident we are on the correct side of the law."

Marijuana organizations are battling the cities of Upland, Riverside, Wildomar and Colton in the appellate court, according to court records.
